Builders in Kharar, Mohali & Zirakpur need to register under RERA

July 31 onward all the Builders in Kharar, Mohali & Zirakpur would need RERA registration. It was reported that the real estate agents, as well as builders who have not yet registered themselves under the Punjab Real Estate Regulatory Authority (RERA), should rush to get themselves registered.

As per the notification of Real Estate (Development & Regulation) Rules 2017, it was stated by the Real Estate Regulatory Authority (RERA) office that it has initiated receiving applications from promoters as well as real estate agents for registration. For the Builders in Kharar, Mohali & Zirakpur it will be mandatory under the new law to register under the Punjab Real Estate Regulatory Authority (RERA).

The deadline for the mandatory registration is July-31 which is all set to expire in a week’s time. It must be noted that there are more than 80 projects that are currently in running stage in Zirakpur and above 100 real estate projects (In different stages of completion) in Mohali and Kharar. Despite this fact that approximate 180 projects are in running stage in this part of the state, only realty agents have moved the applications. With such a huge number of builders in the region only six builders have applied for registration under the new law – RERA.

What if one fails to get RERA registration 

If the builders or the real estate agents miss out the chance to register themselves under RERA it will become difficult for them to survive their business. It was reported that without obtaining the mandatory registration no real estate agent will be able facilitate the purchase or sale of any apartment,  plot or building. Since registration is mandatory under the central act there are no chances that the deadline will be extended and all will have to register before July 31 newly under the newly created real estate watchdog.
If not registered under RERA the department will be forced to invoke Sector 3 (1) of the Punjab Real Estate (Regulation & Development) Rules. This rule mandates that no promoter will be able to advertise, book, market, sell or offer for sale of any apartment/plot/building in a real estate project. Promoters will also not be able to invite intending buyers for purchasing the properties.
Those who want to register must follow the registration process that has been uploaded on www.pbhousing.gov.in.

Conditions under RERA regulations reduce the attractiveness of such funding wherein a developer could offload scores of apartments to either a PE fund or a HNI at a significant discount, collect an upfront amount with a caveat of a minimum guarantee. For all practical purposes, it is as good as a pre-sale to a customer, a practice that RERA curbs.
Now, every sale has to be registered, posing a two fold problem. For one, financiers are unwilling to incur a 7% additional cost to register, that too, on the basis of current ready reckoner rates.

Moreover, sources said, in some cases, such deals were done at a deep discount, even lower than the prevalent circle rates, which might now have income tax obligations, should such transactions be registered.

“It depends on how specific deals were structured. If the financier, for instance, was identified as a partner or a co-promoter of the project, it does not need to be registered,” said Gaurav Gupta, co promoter and director at Omkar Realtors.  Two years back, the company had done a bulk transaction with Piramal Fund Management. Gupta did not disclose particulars of this deal.  But some differ in their assessment. “While it is an option to redefine the roles of stakeholders, an investor would not want to be defined as a partner because it opens him up to all the risks that a promoter has to bear, including jail time,” said Anuj Puri, chairman of ANAROCK Property Consultants, which also runs a segregated fund, invested in bulk transactions.
It is hard to generalize a solution but on a case to case basis, it needs to be seen how dynamics of these agreements can be altered, said Anish Sanghvi, partner at PwC.
Going forward though, Sanghvi does not think bulk transactions will make a major comeback because the current regulation defeats its very purpose.

The first question that would have come up to many is how come only this building was left standing, how strong and more. However the second more important thing that people watching must have thought would have been is “the value of that house”. What if they were in this house? 



    You do not need any explanations of logics to explain the importance of that house or the saneness
    the owner/ builder of that house would have shown while making it. Costly, but nothing is more than life. The people around the world would start doing the currency conversion to find out the cost of that house with the technique and the material he would have used, but the value is best described by the man who is standing outside his brought down home with his family inside.

    People with homes brought down are now in the open fields under the tents. And to add to the misery, there starts rain, ok, still manageable. The tents are water proof, but what about the storm accompanied with the rain? The children in the palms of the mother or left over parents are frightened with this scenario. Looking towards the same house would now make most of  them realize that it was probably one of the biggest mistakes of their lives to have negotiated with the quality of their homes in this aspect. After surviving the quake, that homes gives the 5 th wall on top, a protection from further calamities of the angry nature as well.

    At this point in time, many would like to put everything they are left with to buy a small space
    in that strong home. No wonder, the resale price has any comparison at this time. Building a new one would take time, however until then, that is a priceless deal. So what was actually a timely decision is not just a reason for jealousy but an inspiration to most.

    Chandigarh| Builder Asked To Refund Rs 50 Lakhs For Delaying Handover Of Flats

    The Emaar MGF Land Limited group of Chandigarh builders have been asked to refund Rs 50 lakh along with 15% interest by the consumer court to two flat owners who have accused the builders for not delivering their flats on time. The Consumer Complaint Forum has also directed the Emaar MGF (Chandigarh) Group to pay Rs 2 lakh as compensation and Rs 50,000 as litigation cost.

    The Emaar MGF Land is a well renowned and highly acclaimed real estate developers based in India that undertake residential and commercial projects nationally and has not come under scanner due to consumer dissatisfaction since its initiation. But, this time it looks like the builders are going to get roasted because of its consumers.

    The complaint against the Emaar builders (Chandigarh) has been lodged at the consumer forum by two people named Kulvant Kapur and B S Kapur hailing from Delhi.
